Construction and engineering

Kennedys' highly regarded international construction team is continually involved with contentious and non-contentious construction, engineering and process engineering matters.

On the contentious side we advise insurers and insureds, funders, employers, contractors, developers and consultants, on contractual issues, disputes and diverse projects such as the construction of harbours, tunnels, dams, office blocks, retail centres, power stations, nuclear facilities, bridges and roads. Our practice extends to process engineering matters and also general commercial disputes arising from construction and process engineering.

We have in depth experience in all principal forms of dispute resolution, including litigation before the courts, arbitration (be it domestic or international), mediation, expert determination and adjudication. In addition, we advise insureds and insurers on the application of policies written in relation to construction and engineering projects, not least as to coverage issues.

On the non-contentious side the firm advises funders, employers, contractors and consultants on methods of procurement, drafting and negotiating construction contracts, development and finance agreements, performance bonds, consultant appointments and related documentation. Types of projects in which we have been involved in include power plants and major infrastructure projects, office developments, NHS projects (including hospitals and surgeries), schools and universities, retail and housing projects. We also advise on environmental issues and insolvency matters relating to the construction sector.

In addition we have significant experience of both contentious and non-contentious engineering work, particularly within the nuclear, oil and gas, pharmaceutical and rail industries.
